PORTATİF DUŞ KABİNİ TASARIMI YARIŞMASI
1. YARIŞMA HAKKINDA
Yarışma, “Yıldız Teknik Üniversitesi Sanat ve Tasarım Uygulama Araştırma Merkezi (SATPARK)” ve “Corexall Aluminum Systems” firmasının desteği ile düzenlenen, portatif duş kabini sistemleri odaklı bir tasarım yarışmasıdır.
2. YARIŞMANIN AMACI
Yıldız Teknik Üniversitesi Sanat ve Tasarım Fakültesi ve Corexall Aluminum Systems firmasının işbirliği ile düzenlenen tasarım yarışmasının temel amaçları:
- Sektörde uygulanabilecek yeni ürün ve tasarım yaklaşımlarını belirlemek,
- Banyo tasarımında özgünlüğü artırmak,
- Pratik banyo tasarımında modern fikirler geliştirmek,
- Tasarım aracılığı ile ürünlerde katma değer yaratarak sektörü canlandırmak,
- Üniversite-Sanayi işbirliği ile bu alanda çalışacak yeni tasarımcılar yetiştirilmesini teşvik etmek,
- Özgün tasarıma sahip ulusal ürün üretimi ile ülkemizin ihracat potansiyelini arttırmak,
- Türkiye’de tasarım kavramının önemini ve değerini yaygınlaştırmak.
3. YARIŞMAYA KATILIM KOŞULLARI
- Yarışmaya katılım ücretsizdir.
- Yarışma, Mimarlık, Mühendislik, Sanat ve Tasarım Fakültelerinde lisans veya lisansüstünde eğitimine devam eden tüm öğrencilerin katılımına ve özgün tasarımcıların başvurusuna açıktır.
- Katılımcılar bireysel veya grup olarak yarışmaya katılım sağlayabilir.
- Grup katılımlarında bir kişi grup lideri olarak belirlenmeli ve gruplar en fazla 4 kişiden oluşmalıdır.
- Yarışma başvurularında proje başvuru sınırı bulunmamaktadır. Bir yarışmacı; farklı olmak kaydı ile birden fazla proje ile yarışmaya katılabilir.
- Yarışmaya, danışman, seçici kurul asil ve yedek üyeleri ve yarışmayı açan kurum birimi yöneticilerinin birinci derecede yakınları katılamaz.
- Yarışmaya katılan her projede özgünlük, daha önce üretilmemiş olması, başka bir yarışmada ödül almamış olması şartları aranmaktadır.
- Yarışmaya gönderilen eserin özgün bir çalışma olmaması, aksine bir iddia olması ve üçüncü kişilerin tasarım üzerinde hak iddia etmesi durumunda sorumluluk yarışmacıya aittir.
Yukarıda sayılan maddeler kapsamında aksi bir durumun tespiti halinde, ilgili projeler ve yarışmacılar yarışmadan diskalifiye edilir. Ödül kazanıldıysa, yarışmacı ödülü yarışmayı düzenleyen kuruluşa iade etmek zorundadır.
4. YARIŞMANIN KONUSU VE KAPSAMI
Yarışma, piyasadaki mevcut duş kabini sistemlerine getirilebilecek özgün ve inovatif “portatif” çözümleri içeren ürün tasarımları teması kapsamında yapılacak olup, kullanıcının desteğe ihtiyaç duymadan duş kabini kurabileceği ve monte edebileceği özgün tasarım ile yarışmada dereceye giren tasarımlar ödüllendirilecektir.
5. TASARIM KRİTERLERİ VE DEĞERLENDİRME ÖLÇÜTLERİ
Yarışmaya kabul edilen tasarımlar aşağıdaki ölçütlere göre değerlendirilecektir:
1. Tasarımın özgün ve yenilikçi olması,
2. Tasarımın üretilebilir ve sanayiye uygulanabilir olması,
3. Tasarımın fonksiyonel ve kullanıcı dostu olması,
4. Ürünün, karar verilen temel tasarım problemine/ihtiyacına yönelik yeni bir çözüm getirebilmesi,
5. Üründe seçilen malzemenin tasarıma uygunluğu ve çevre dostu olması,
6. Tasarım önerisinin estetik açıdan yeterliliği,
7. Tasarımın üretim, kullanım ve geri dönüşüm süreçlerinde çevreye duyarlı olması.
6. KATILIM ŞEKLİ VE ADRESİ
Yarışma için tasarlanan duş kabini teknik çizimi DWG formatında 1/1 ölçekli olarak tasarimyarismasi2022@gmail.com e-posta adresine 09.06.2023 tarihi mesai bitimine kadar gönderilmelidir. Jüri üyeleri tarafından değerlendirilen ve ilk 10’a giren tasarımlar ilan edilecektir. Tasarımcılarının yönlendirmesiyle ilk 10’da ilan edilen tasarım Corexall Aluminum Systems” firmasının fabrikasında prototipi hazırlanarak jüri üyelerine sunulacaktır. Son değerlendirmenin ardından tasarımlardan ilk 3’te yer alan ve mansiyon ödülünü hak edenler belirlenerek duyurulacaktır.

10. FİKRİ VE SİNAİ HAKLAR ve ÇEŞİTLİ HÜKÜMLER
Katılımcılar, herhangi bir üçüncü kişi tarafından geliştirilmiş yeni bir patent, tasarım, buluş ve benzeri fikri hakları ihlal etmeyeceğini kabul ve taahhüt eder.
Katılımcılar, yarışma şartları uyarınca vücuda getirdiği ve getireceği ve yarışma sırasında vücuda gelmesi muhtemel 5846 sayılı Fikir ve Sanat Eserleri Kanunu (“FSEK”) kapsamında eser olarak nitelendirilebilecek olan her türlü materyal üzerinde FSEK uyarınca doğacak işleme, çoğaltma, yayma, temsil ve işaret, ses ve/veya görüntü nakline yarayan vasıtalarla umuma iletim şeklindeki mali haklarını ayrı ayrı, FSEK’in 48. ve 52. maddeleri ile uyumlu olacak şekilde, 3. kişilere de kullandırtabilecek şekilde, herhangi bir süre, yer ve sayı sınırı olmaksızın, gayrikabili rücu olarak açıkça Corexall Aluminum Systems’e devretmeyi taahhüt ettiğini, Yarışmaya katılmakla sayılan tüm hakların Corexall Aluminum Systems’e kendiliğinden devredilmiş sayılacağını ve hiçbir hak, alacak, ücret ve sair bir hakkı kalmadığını ve bu Yarışmada meydana gelen esere ilişkin bir talepte bulunmayacağını kabul, beyan ve taahhüt eder.
Katılımcılar, meydana getirdikleri eser ile ilgili tüm fikri ve sinai hakları Corexall Aluminum Systems’e devredeceğini kabul, beyan ve taahhüt eder. Katılımcılar, işbu devri gerçekleştirmemesi halinde Corexall Aluminum Systems’in herhangi bir zarara uğraması halinde Corexall Aluminum Systems’in uğradığı/uğrayabileceği her türlü zararı tazmin edecektir. Katılımcılar, meydana gelen eserlerin tümünde veyahut bir kısmında hiçbir hak iddiasında bulunamayacağı gibi, yarışma neticesinde ortaya çıkacak ve fikri mülkiyet hakkına konu olacak hiçbir yapımı, eseri vs. kullanamaz ve üçüncü kişilere kullandıramaz.
Katılımcılar, Fikri Mülkiyet Hakları maddesinde belirtilen tüm hususlar ile ilgili üçüncü kişilerin haklarının ihlal edilmesi iddiası ile Corexall Aluminum Systems’e yöneltebilecekleri her türlü talep ve şikâyetten Corexall Aluminum Systems’i ari tutacak, Corexall Aluminum Systems’in bu nedenle maruz kalabileceği her türlü zarar ile ilgili maddi veya manevi tazminat bedellerini ve Corexall Aluminum Systems’in aleyhine oluşacak tüm hukuki sonuçları, ilk talep halinde başkaca bir merasime gerek kalmaksızın, derhal, nakden ve defaten tazmin edecektir.
Corexall Aluminum Systems, ödül kazanan eserler ile Yarışmaya katılan tüm yarışmacıların eserlerinin telif haklarını devralmak kapsamında, ayrıca bir ücrete tabi olmaksızın, FSEK’ten doğan, FSEK’in 20, 21, 22, 23, 24 ve 25. maddelerinde yazılı işleme, çoğaltma, yayma, temsil ve işaret, ses ve/veya görüntü nakline yarayan araçlarla umuma iletim (uyduyla ve kabloyla yayın hakkı da dâhil) ve uluslararası mevzuattaki erişilebilir kılma şeklindeki tüm mali haklarının, FSEK’de tanımlanan yasal koruma süreleri boyunca ve Türkiye ile birlikte tüm dünyada geçerli olacak şekilde bedelsiz olarak yarışmacılardan devralır.
Yarışmacılar, Corexall Aluminum Systems’in söz konusu hakları dilediği gibi kullanma ve/veya kullanmama yetkisine sahip olduğunu gayrikabili rücu kabul ve taahhüt ederler.
İşbu devrin gerçekleştirilebilmesi için ilgililer, gerektiğinde veya Corexall Aluminum Systems talep ettiğinde tüm mali hakların Corexall Aluminum Systems’e devri için derhal, Corexall Aluminum Systems tarafından hazırlanmış devir sözleşmenin imzalanacağını, sözleşmenin ayrıca bir ücret talebi olamayacağını, sözleşmenin imzalanmasından imtina edilmeyeceğini, aksi takdirde ödül kazanma hakkının elinden alınacağını ve ödül kazanmış olsa dahi ödülünün aykırılık nedeni ile kendisine teslim edilmeyeceğini gayrikabili rücu kabul ve taahhüt eder.
Yarışmacılar, yarışmaya katılan tüm yarışmacıların fotoğraf ve görüntüleri (fotoğraf ve/veya kamera) ile ilgili tüm haklarını Corexall Aluminum Systems’e devir etmiş olmayı kabul eder. Yarışma kapsamında çekilen söz konusu fotoğraf ve görüntüler Corexall Aluminum Systems tarafından, dilediği zaman, gazete, dergi, televizyon, dijital medya gibi mecralarda reklam amaçlı kullanılabilir.
Katılımcılar, herhangi bir ihtilaf vukuunda, Hukuk Muhakemeleri Kanunu’nun 193üncü maddesine istinaden Corexall Aluminum Systems’in elektronik posta, yazışma, tebligatları, raporları, faks mesajları, defter ve kayıtları, bilgisayar kayıtları, mikrofilmleri ve mikro-fişleri ile makbuz ve faturaları ve sahip olduğu ticari defter ve kayıtları kesin delil kabul edileceğini kabul etmektedir.
PORTABLE SHOWER CABINET DESIGN COMPETITION
1. ABOUT THE COMPETITION
The competition is a design competition focused on portable shower cabin systems, organized with the support of "Yıldız Technical University Art and Design Application Research Center (SATPARK)" and "Corexall Aluminum Systems".
2. PURPOSE OF THE COMPETITION
The main objectives of the design competition, organized in cooperation with Yıldız Technical University Faculty of Art and Design and Corexall Aluminum Systems, are:
To identify new product and design approaches that can be applied in the sector,
To increase originality in bathroom design,
Developing modern ideas in practical bathroom design,
To revive the sector by creating added value in products through design,
To encourage the training of new designers to work in this field with the cooperation of University-Industry,
To increase the export potential of our country with the production of national products with original designs,
To spread the importance and value of the concept of design in Turkey.
3. TERMS OF PARTICIPATION IN THE COMPETITION
Participation in the competition is free.
The competition is open to the participation of all students who continue their undergraduate or graduate education in the Faculties of Architecture, Engineering, Art and Design and to the application of original designers.
Participants can participate in the competition individually or as a group.
In group participation, one person should be determined as the group leader and the groups should consist of a maximum of 4 people.
There is no project application limit for competition applications. a competitor; can participate in the competition with more than one project, provided that they are different.
Consultants, full and substitute members of the selection committee and first-degree relatives of the managers of the institution that opened the competition cannot participate in the competition.
Every project participating in the competition is required to be original, not to have been produced before, not to have received an award in another competition.
In case the work submitted to the competition is not an original work, there is a claim to the contrary and third parties claim rights on the design, the responsibility belongs to the competitor.
In the event that a contrary situation is determined within the scope of the above-mentioned articles, the relevant projects and competitors are disqualified from the competition. If the prize has been won, the contestant has to return the prize to the organizer of the contest.
4. SUBJECT AND SCOPE OF THE COMPETITION
The competition will be held under the theme of product designs that include original and innovative “portable” solutions that can be brought to the existing shower cabin systems in the market, and the designs that are ranked in the competition with the original design in which the user can install and assemble the shower cabin without the need for support will be awarded.
5. DESIGN CRITERIA AND EVALUATION CRITERIA
The accepted designs will be evaluated according to the following criteria:
1. The design is original and innovative,
2. The design can be produced and applied to the industry,
3. The design is functional and user-friendly,
4. The product's ability to bring a new solution to the main design problem/need decided upon,
5. The suitability of the material selected for the product with the design and its environmental friendliness,
6. Aesthetic adequacy of the design proposal,
7. Design to be sensitive to the environment in production, use and recycling processes.
6. PARTICIPATION METHOD AND ADDRESS
The technical drawing of the shower cabin designed for the competition should be sent to the e-mail address designarismasi2022@gmail.com in DWG format in 1/1 scale until the end of the working day on 09.06.2023. The designs that are evaluated by the jury members and placed in the top 10 will be announced. Announced in the top 10 with the guidance of its designers, the prototype of the design will be prepared in the factory of Corexall Aluminum Systems and presented to the members of the jury. After the final evaluation, those who are in the top 3 of the designs and deserve the honorable mention will be determined and announced.

10. INTELLECTUAL AND INDUSTRIAL RIGHTS AND VARIOUS PROVISIONS
Participants agree and undertake that they will not violate any new patent, design, invention and similar intellectual rights developed by any third party.
Processing, reproduction, dissemination, representation and sign, sound, which will arise in accordance with FSEK on all kinds of materials that can be qualified as works within the scope of the Law on Intellectual and Artistic Works (“FSEK”) numbered 5846 (“FSEK”), which they have created or will bring into existence in accordance with the conditions of the competition. and/or by means of image transmission, clearly and irrevocably, without any time, place and number limit, in a way that can make third parties use their financial rights separately, in accordance with Articles 48 and 52 of the FSEK. It accepts, declares and undertakes that it undertakes to transfer it to Corexall Aluminum Systems, that all the rights enumerated by participating in the Contest will be deemed to have been automatically transferred to Corexall Aluminum Systems and that it will not have any rights, receivables, fees or other rights, and that it will not make a claim regarding the work created in this Contest. .
Participants accept, declare and undertake that they will transfer all intellectual and industrial rights related to the work they create to Corexall Aluminum Systems. In the event that Corexall Aluminum Systems does not carry out this transfer, the Participants shall indemnify any and all damages that Corexall Aluminum Systems suffers or may suffer in case of any loss. Participants may not claim any rights in all or part of the works, and they cannot claim any productions, works, etc., which will emerge as a result of the competition and which will be subject to intellectual property rights. cannot be used and cannot be used by third parties.
Participants will keep Corexall Aluminum Systems free from any claim and complaint they may bring to Corexall Aluminum Systems with the allegation of violating the rights of third parties regarding all matters specified in the Intellectual Property Rights article, and any damages that Corexall Aluminum Systems may suffer for this reason. will immediately indemnify, in cash and in full, the relevant pecuniary or non-pecuniary damages and all legal consequences that may arise against Corexall Aluminum Systems, without the need for any other ceremony, upon the first request.
Corexall Aluminum Systems, within the scope of taking over the copyrights of the prize-winning works and the works of all the contestants participating in the Contest, without any additional charge, arising from FSEK, written in Articles 20, 21, 22, 23, 24 and 25 of FSEK, all financial rights in the form of broadcasting, representation and transmission to the public by means of signal, sound and/or image transmission (including the right to broadcast by satellite and cable) and making it accessible in international legislation are valid throughout the legal protection periods defined in FSEK and all over the world together with Turkey. will be taken over from the competitors free of charge.
Competitors irrevocably agree and undertake that Corexall Aluminum Systems has the authority to use and/or not use such rights as it wishes.
For the realization of this transfer, when necessary or requested by Corexall Aluminum Systems, the transfer agreement prepared by Corexall Aluminum Systems will be signed immediately for the transfer of all financial rights to Corexall Aluminum Systems, the agreement cannot be an additional fee, the contract will not be avoided, otherwise the award will not be awarded. He irrevocably accepts and undertakes that his right will be taken away from him and that even if he has won the prize, the prize will not be delivered to him due to contradiction.
Competitors agree to have transferred all their rights regarding the photographs and images (photo and/or camera) of all contestants participating in the competition to Corexall Aluminum Systems. The photographs and images taken within the scope of the competition can be used by Corexall Aluminum Systems for advertisement purposes at any time in media such as newspapers, magazines, television and digital media.
In case of any dispute, the Participants may submit e-mails, correspondence, notifications, reports, fax messages, books and records, computer records, microfilms and micro-slips and receipts and invoices of Corexall Aluminum Systems pursuant to Article 193 of the Code of Civil Procedure. accepts that his commercial books and records will be accepted as conclusive evidence.
